Terms and Conditions of Sale
1. Background
1.1 These General Terms and Conditions (the “General Conditions”) govern all orders placed by you, the consumer (“Customer”), through www.onyxarthouse.com and related pages (the “Website”). The agreement is made between you and Onyx Art House, with all relevant contact and company information available on the Website. These conditions apply exclusively to consumers.
1.2 Customers must be at least 18 years of age to place an order on the Website. Onyx Art House does not accept credit purchases from individuals under 18 years old, in accordance with US law. Onyx Art House reserves the right to cancel or alter any order if incorrect personal data is provided or if there is a history of non-payment.
1.3 Onyx Art House is not responsible for sold-out products or errors in product descriptions, prices, specifications, or stock status. We reserve the right to correct such errors and adjust information as needed. If an incorrect price is listed for an ordered product, we will notify the Customer and seek approval before proceeding with the order. Images on the Website are for illustrative purposes only and may not exactly represent the product.
1.4 The content and design of the Website are the property of Onyx Art House or its licensors and are protected by intellectual property laws. Trademarks, product names, images, graphics, and any other content may not be reproduced without express written permission from Onyx Art House.
2. Contracts and Orders
2.1 To place an order on the Website, the Customer must accept these General Conditions. By accepting these terms, the Customer agrees to comply fully with them and acknowledges the Privacy Policy and Cookies Policy.
2.2 A purchase agreement is finalized when Onyx Art House confirms the Customer’s order, and the Customer receives an order confirmation email. The Customer can cancel their order before confirmation, at which point Onyx Art House will issue a refund for any payments made.
3. Customer Information
3.1 When registering an account or placing an order, the Customer must provide accurate personal information. The Customer is responsible for any errors in the information provided. Onyx Art House’s handling of personal data is governed by our Privacy Policy.
3.2 The Customer must ensure that only they use their account login details. The Customer is responsible for all purchases made under their account and must notify Onyx Art House immediately if unauthorized access is suspected.
3.3 If Onyx Art House suspects account misuse, we reserve the right to block access or change login details.
4. Prices, Fees, and Payment
4.1 All prices are listed in USD and exclude shipping, payment fees, and applicable taxes, including customs duties. Additional charges may apply based on the delivery destination.
4.2 The Customer may pay using the available payment methods listed on the Website. Onyx Art House reserves the right to alter payment options or request a different method if issues arise with the chosen payment method.
5. Special Offers
From time to time, Onyx Art House may offer special deals with more favorable terms than the General Conditions. These offers are valid only for the specified period or while supplies last and may be withdrawn at any time.
6. Delivery and Shipping
6.1 In-stock products are typically delivered within the specified number of working days. If products are out of stock, delivery may take up to 30 working days. Customers should contact Customer Service if an order is delayed beyond this time frame.
6.2 If a delivery is delayed more than 30 working days and not due to the Customer, the Customer may cancel the order.
6.3 For packages requiring pickup, the Customer must collect them within the specified time. Failure to do so will result in a $22 fee. A valid ID and order number are required for collection.
7. Changes to the General Conditions
Onyx Art House reserves the right to amend these General Conditions at any time. Any changes will be posted on the Website, and they will take effect either upon the Customer's acceptance of the updated terms or 30 days after notification.
8. Severability
If any provision of these terms is found to be invalid or unenforceable, the remainder will remain in effect. Invalid provisions will be replaced with lawful alternatives.
9. Applicable Law and Dispute Resolution
9.1 Disputes should first be addressed through Onyx Art House’s customer service.
